Volume 8 of the Decisions of the Arbitration Panel

The 21 decisions published in the volume were issued in the years 2009 and 2010. Within the scope of these decisions the Arbitration Panel examined a total of 58 applications for in rem restitution of properties or parts of properties situated in the federal provinces Vienna, Lower Austria, Carinthia and Styria. None of the decisions dealt with moveable assets. On the cut-off date in 2001 the requested properties or parts of properties were owned by the Republic of Austria or a company owned by the Republic of Austria such as the Bundesimmobiliengesellschaft (“Federal Real Estate Company”) and the Österreichische Bundesbahnen (“Austrian Federal Railways”), the Provinces of Carinthia and Lower Austria or the Municipality of Bad Vöslau.

The 21 decisions published in this volume include three decisions relating to 13 applications recommending restitution, and two supplementary decisions issued in conjunction with these favorable decisions, in which the Arbitration Panel recommended that a comparable asset be awarded pursuant to Sec. 34 of the GSF Law. This volume also contains 14 decisions in which a total of 42 applications are either rejected or dismissed13, and two decisions in which three applications to have proceedings reopened that had been concluded in 2006 and 2008 respectively were rejected.
