Description

While the customary means of acquisition in cultural institutions, such as purchase, donation, obligation and exchange constitute the most common business transactions, fiduciary takeovers, particularly in the context of Nazi era provenance research, and state transformation processes must be subject to skepticism. In Germany and Austria, in the field of art restitution, (looted) objects are often involved that passed into the ownership of public institutions between 1933 and 1945, or in the postwar period, and often turn out to be of problematic provenance. On the other hand, Jewish organizations often had to take on heirless objects after the Shoah as they did not want them to be forfeited to the state, i.e. to the perpetrators. Librarians, historians, collection representatives and legal experts from Austria and abroad will be invited to discuss, in an interdisciplinary environment, structured approaches and the demands, chances and limits of an adequate method of dealing with illegitimately acquired objects within the scope of fiduciary acquisition. The conference will be embedded in two networking meetings of Austrian and German Nazi era provenance researchers in order to reach the greatest possible audience. The results will be published in a conference publication.

Während die gängigen Erwerbungsarten in Kultureinrichtungen, wie Kauf, Geschenk, Pflicht und Tausch übliche Geschäftsvorgänge darstellen, sind treuhänderische Übernahmen jedoch gerade im Kontext der NS-Provenienzforschung und staatlichen Transformationsprozessen als kritisch einzustufen. In Deutschland und Österreich handelt es sich in den Kulturinstitutionen oftmals um (Raub-)Objekte, die von NS-Institutionen zwischen 1933–1945, beziehungsweise in der Nachkriegszeit, an öffentliche Einrichtungen übergegangen sind und die nicht selten problematische Provenienzen aufweisen. Jüdische Organisationen hingegen mussten nach der Shoah oftmals erblose Objekte übernehmen, da man diese nicht an den Staat, also an die Täter, verfallen lassen wollte. BibliothekarInnen, HistorikerInnen, Sammlungsbeauftragte und RechtsexpertInnen aus dem In- und Ausland werden eingeladen, strukturierte Vorgehensweisen zu erörtern und die Anforderungen, Chancen und Grenzen eines adäquaten Umgangs mit illegitim erworbenen Objekten im Rahmen einer treuhänderischen Übernahme interdisziplinär zu diskutieren. Die Tagung wird, um einen bestmöglichen Outreach zu erreichen, in zwei Vernetzungstreffen österreichischer und deutscher NS-Provenienzforschungsnetzwerke eingebettet. Die Ergebnisse sollen in einem Tagungsband veröffentlicht werden.
