Arbitration Panel for In Rem Restitution: Application Processing Completed

The Arbitration Panel for In Rem Restitution has finished processing all of the 2,307 applications that it received for in rem restitution of public property.

The last application to be pending with the Arbitration Panel was withdrawn on 30 November 2018. In total, the Arbitration Panel decided 2,006 applications; 69 applications were withdrawn and 232 applications were concluded without a decision.

On the basis of the Arbitration Panel’s decisions the public owners restituted real estate assets to 140 applicants in an amount totaling approx. 48 million euros, with 9 million euros of this sum being awarded in the form of a comparable asset paid to the applicants by the public owners. All of the Arbitration Panel’s recommendations were complied with in full by the respective public owners.

The Arbitration Panel for In Rem Restitution was established at the General Settlement Fund for Victims of National Socialism on the basis of the Washington Agreement and the General Settlement Fund Law of 2001. It decides on applications for in rem restitution of publicly-owned assets. The governments of the United States of America and the Republic of Austria each nominated one Member. The Chairman was then nominated by these two Members. The Chairman of the Arbitration Panel is Emeritus Professor Joseph Aicher; the US-American nominee is University Professor August Reinisch and the Austrian nominee is Retired Ambassador Erich Kussbach.
